Restrictions
of ​your criminal record

     Georgia Bureau of Investigations is the reporting agency of your criminal background.  Except in the following circumstances, record restrictions are controlled by the prosecuting agency and occur by operation of the law, without the need for an arrestee or defendant to take affirmative action:
  •      For arrests prior to July 2013, record restrictions must be applied for, and the application with instructions can be found by clicking the following link to the GBI website:  Record Restriction Application.
   Currently, the law allows for certain arrests to be restricted automatically if there is no disposition after a specified  amount of time; specific information regarding this can be found by clicking the following link:  Time Expired Restrictions.

    In addition, regardless of one's eligibility for record restriction, the State Board of Pardons and Paroles has an application process to request restoration of civil rights, such as gun ownership, serving on a jury and holding public office. Take note that Voting Rights are automatically restored upon completion of any given sentence.
