The criminal justice system is laced with discretion which allows for tremendous disparity.  With the understanding that incarceration rates are on the rise, although crime rates have declined, and  racial and gender disparity exists throughout the system, with black men being the most likely stopped by police and subsequently arrested and convicted, it is important to be able to make informed decisions and actions when interacting with police.

General Tips for Police-Citizen Encounters

  1. Do Not Run From Police!  
  2. Keep Hands Visible and do not reach toward or touch Police
  3. Explicitly and Verbally Deny Consent to Searches : "I do not consent to a search"
  4. Do not offer information other than Name / Address  upon request.   ​Explicitly request an attorney if interrogated: "I do not want to talk with you without a lawyer. May I have a lawyer?"
  5. Do not argue with Police; Answer Questions with Questions:  "Am I free to leave?" "Am I under arrest?"

Remember, you may not be able to win your legal battles while out on the street; however, the above-stated tips may aid in you to be in a position to help facilitate a winning battle in court.  Sometimes no matter what you do, you may find yourself falling victim to police hostility or brutality.  During an inappropriate police interaction, take note of the officer's badge number, jurisdiction, name and/or police vehicle so that you are sufficiently informed to file a formal report with internal affairs.
